1. BINDING ARBITRATION AND CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Governing Law: Any disputes arising from or relating to these Terms or your use of our Services shall be governed by the laws of the State of Colorado.

Mandatory Arbitration: You and A Little Help Here Media, LLC agree that any and all disputes, claims, or controversies arising out of or relating to your use of our Services, including but not limited to claims under the Telephone Consumer Protection Act ("TCPA") and the CAN-SPAM Act, shall be resolved by binding arbitration. Arbitration will be administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Boulder County, Colorado.

Waiver of Jury Trial: You and the Company expressly waive any constitutional and statutory rights to go to court and have a trial in front of a judge or a jury.

Class Action Waiver: You and the Company further agree that any arbitration will be conducted solely on an individual basis and not in a class, collective, or representative action. You expressly waive your right to bring any action as a class plaintiff or class member.

2. GENERAL TERMS AND ACCEPTANCE

These Terms govern your use of the websites, applications, and services (collectively, the "Services") operated by A Little Help Here Media, LLC ("the Company," "we," "us," or "our"). The term "AddressGenie" is a trademark and brand name used to refer to the specific moving-related services we provide. By using our Services, you agree to these Terms and any future updates. We reserve the right to change these Terms at any time, effective immediately upon notice published on this page. Your continued use of the Services constitutes your binding acceptance of these Terms.

Important Note to New Jersey Consumers: The limitations and disclaimers in these Terms are intended to be only as broad and inclusive as permitted by New Jersey law. Nothing in this document is intended to limit any rights you may have as a consumer under New Jersey law.

3. DESCRIPTION OF SERVICES AND DISCLAIMERS

Our Service: Our "AddressGenie Service" is a premium, one-time service that helps customers notify the USPS and other companies of a new address. You authorize us to act as your agent to facilitate these address change requests. We charge a one-time fee of $49.95 for this service. This fee covers our administrative costs, the official USPS change of address fee, and an unlimited number of company change requests.

USPS Disclaimer: WE ARE NOT AFFILIATED WITH THE U.S. POSTAL SERVICE (USPS). All trademarks of the USPS used on our sites are the exclusive property of the United States Postal Service. We expressly disclaim ownership of any products or services belonging to the USPS. If you only wish to file your address change with the USPS, you can do so directly by visiting their official website, usps.com.

Our Guarantee: We will use reasonable best efforts to notify the associated entities of your address change requests. However, we expressly do not guarantee that any of the organizations notified by us will process the requests we send as your agent. You acknowledge that we are not liable in any way for the failure of any such address change request.

By providing your phone number and/or email address on our Properties, you are providing your explicit written consent to receive marketing and promotional communications from us. These communications may be sent via email, telephone calls, and text messages. You understand that these communications may be generated using an automatic telephone dialing system (ATDS), an artificial or prerecorded voice, and/or other automated technology, and that message and data rates may apply. Your consent to receive these communications is not a condition of purchasing any goods or services.

Our business model is based on providing third-party businesses with access to consumer information. By using our Services and providing us with your personal information, you acknowledge and agree that we may sell, rent, or lease your personal information, including your email address and phone number, to our affiliated and non-affiliated third-party marketing partners for their own marketing, promotional, and lead generation purposes.

These partners may use this information to contact you with offers and promotions via email, telephone calls, and text messages. We require all of our partners to adhere to all applicable laws and regulations, including the TCPA and the CAN-SPAM Act.

6. PAYMENT, REFUNDS, AND CANCELLATION

Payment: The service fee of $49.95 will be billed upon registration. You grant us and our third-party payment processors permission to charge your credit card or other approved payment method for this fee.

Refunds: We offer a 30-day "No Questions Asked" refund policy. You may request a full refund of your service fee at any time within 30 days of your registration. To request a refund, you must send an email to [email protected] with "Refund Request" in the subject line. We cannot honor any refund requests received after this 30-day period.

Cancellation: You may cancel any or all of your communication services at any time.

Email Offers: You can unsubscribe by clicking the "Unsubscribe" link at the bottom of any email.
Text Message Offers: You can unsubscribe by replying "STOP" to any text message you receive from us.
Location-Based Offers: You must adjust the notification settings within the app that provides these offers.

We may terminate your account at our sole discretion, without refund, if we believe you have violated these Terms.

7. USER ACCOUNTS, RESPONSIBILITIES, AND CONDUCT

You agree to provide true, accurate, and complete registration information. You are responsible for all activities that occur under your username and for keeping your password secure.

Rules of Conduct: You agree not to use our Services for any commercial purpose not authorized by us, to post obscene or pornographic material, to post false or misleading information, to transmit viruses, to engage in any harassing or illegal activity, or to harvest or collect user contact information by any means. This is not an exhaustive list.

8. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

THE SERVICES ARE PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. YOU EXPRESSLY AGREE THAT THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SERVICES IS ASSUMED SOLELY BY YOU.

IN NO EVENT SHALL A LITTLE HELP HERE MEDIA, LLC, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY DAMAGE OR LOSS SHALL IN NO EVENT EXCEED THE GREATER OF (I) THE TOTAL FEES PAID BY YOU IN THE SIX MONTHS PRIOR TO THE DATE OF THE INITIAL CLAIM, OR (II) ONE HUNDRED U.S. DOLLARS ($100.00).

9. INDEMNIFICATION

You agree to indemnify, defend, and hold A Little Help Here Media, LLC and its affiliates harmless from and against any and all claims, liability, losses, damages, costs, and expenses (including attorneys' fees) incurred in connection with your use of, or connection to, our Services or your violation of these Terms.

10. INTERNATIONAL USE

We make no claims that our Services are appropriate or may be used outside of the United States. If you access our Services from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

11. MISCELLANEOUS

No Unsolicited Ideas: We do not accept unsolicited ideas of any kind.
Copyright Policy: You may not post, distribute, or reproduce any copyrighted material, trademarks, or other proprietary information without the prior written consent of the owner.
Privacy Policy: Our Privacy Policy is an integral part of these Terms and is incorporated by reference.
Changes to Terms: We reserve the right to modify these Terms at any time.
